Product Description

This Cases and Materials on Contracts: Making and Doing Deals casebook breaks with tradition to provide both a theoretical and practical understanding of contract law doctrine and policy through a balanced blend of conventional casebook style, concise text, and practice problems. Extending beyond how to recognize issues and apply legal concepts in class, the authors seek to give students a functional understanding of how to do contract law in the "real world."

A diverse blend of cases - the classics, those containing insightful analysis of important legal issues, and those involving cotemporary issues or clauses, such as arbitration - have been carefully selected to capture reader interest, expose students to contract law doctrine, and present practice and policy issues.

  • New “You be the Lawyer!” feature following each principal case title where the student plays a planning or counseling role—i.e., how they might have avoided the problem in the first place, or how they will advise a client to behave in the future, or asking the student to evaluate the litigation strategy.
  • Chapter 1 has been reorganized  to start with an actual case, and a new section on “law and equity” has been added.
  • In Chapter 2, the material on Electronic Contracting has been expanded quite a bit to take account of contemporary developments in the area.
  • In Chapter 3, two of the promissory estoppel cases have been replaced and new material added to deal with the explosion of case law since 2008 involving the use of the doctrine in connection with home mortgage modification promises.
