Product Description

Federal and State Civil Procedure Handbook is intended to serve as a supplement to the basic law school civil procedure course(s), as well as to other civil litigation courses. Like other such supplements, it contains federal procedure and evidence rules and statutes together with federal constitutional provisions relevant to civil litigation in the Article III federal courts. Unlike other supplements, however, it incorporates other crucial materials, including selected provisions from the Model Rules of Professional Conduct, the Restatement of the Law Governing Lawyers, and the Federal Judiciary Act of 1789. Most significantly, it also contains many comparative state law provisions which follow directly the relevant federal rules, statutes and constitutional provisions and which demonstrate how state civil litigation practices may differ from federal civil litigation practices. Finally, it includes selected criminal procedure rules which permit comparisons between civil and criminal litigation.

Table of Contents includes:
Part I: Selected Federal Constitutional Provisions With Comparative State Laws;
Part II: Federal Rules of Civil Procedure With Comparative State Laws;
Part III: Appendix of Forms for Federal Rules of Civil Procedure;
Part IV: Selected Sections of the United States Code With Comparative State Laws;
Part V: Selected ABA Model Rules of Professional Conduct With Comparative State Laws;
Part VI: Selected Federal Rules of Evidence With Comparative State Laws;
Part VII: Selected Federal Rules of Criminal Procedure;
Part VIII: Federal Rules of Appellate Procedure With Comparative State Laws;
Part IX: Selected United States Supreme Court Rules With Comparative State Laws;
Part X: Selected Provisions from the Restatement of the Law Governing Lawyers (Third);
Part XI: Supplementary Federal Rules for Certain Admiralty and Maritime Claims;
Part XII: Selected Provisions from the Federal Judiciary Act of 1789;
Part XIII: Table to Calculate Number of Days.
