American University professor, Elizabeth Boals, has tapped the most basic scenario that a new attorney will experience - the DUI case file - and added the charge of felonious hit and run. The victim in this particular case suffered first and second degree burns from his coffee when his parked vehicle was allegedly sideswiped by Jordan Peyton.
With materials included for the trial of the defendant on these charges, Boals, provides student opportunities to consider the following criminal trial issues:
• medical expert testimony
• character evidence
• criminal conviction impeachment
• bias impeachment
• prior recorded testimony
• evidence from a 911 call
• breath test computer printout
Understanding that some trial advocacy classroom have time restraints and limited training opportunities, Boals offers optional expert testimony for each party on Peyton's likely BAC at the time of the accident. Parties are gender neutral and can be played by either man or woman. Digital versions of the exhibits are provided on the accompanying CD for student use.
State v Peyton plays out in the City of NITA. The file contains the indictment, statements, exhibits, preliminary hearing transcripts, NITA statutes, and case law, and proposed jury instructions and verdict form. If you provide the environment NITA will provide the setting for a most interesting experiential classroom.
