This Special Education Law: Cases and Materials casebook is designed for schools of education and law schools. While accessible to students whose background is in education rather than law, Special Education Law also includes the original court cases and comprehensive, reliable descriptions of the law as well as provocative comments and discussion questions. The necessary background information about the theory and practice of special education and disability civil rights is found throughout the cases and materials. The first chapter of the book, on Core Concepts, introduces many of the basics of the course and contains a section devoted to sources of law that is primarily an aid to students who do not have formal legal training. The rest of the chapters are sufficiently independent of each other to allow instructors flexibility to choose topics that are the most useful to cover in a particular course.

Coverage of the Individuals with Disabilities Education Improvement Act of 2004: Enacted while Special Education Law was in preparation, the 2004 Act becomes effective, for the most part, July 1, 2005. Regulations have not yet been written to enforce it. The 2004 Act leaves the core of IDEA intact; therefore, this book focuses on existing law, with brief descriptions - where appropriate - of how the 2004 Act will alter existing law. The Appendix provides a comprehensive description of the 2004 Act and how it is expected to operate.
