Marketing Program Rules


THE BARRISTERBOOKS.COM STUDENT MARKETING REPRESENTATIVE AGREEMENT

This text represents the Student Marketing Representative Agreement (“Agreement”) between the BarristerBooks.com Student Marketing Representative (“Marketing Rep” or “You”) and BarristerBooks.com (“We”). As a BarristerBooks.com Student Marketing Representative, you are entitled to certain benefits in exchange for the performance of certain responsibilities.

A. MARKETING REPRESENTATIVE RESPONSIBILITIES:

1. Congratulations on your decision to become a BarristerBooks.com Student Marketing Representative! As a BarristerBooks.com Student Marketing Representative, you will be expected to perform one or more promotional tasks each semester. A list of possible tasks will be provided to you by the Student Marketing Representative Coordinator. The number of tasks you complete each semester is decided on by you. However, if there is a task you cannot perform, BarristerBooks.com reserves the right to assign another representative to complete that task.

2. For the purposes of this Agreement, a semester is defined as the term from January 1 through May 15 (Spring Semester) and August 14 through December 15 (Fall Semester). We expect selected tasks to be completed within ten days of your receipt of materials, unless otherwise noted.

3. Length of Term, Renewal, and Forfeiture. Your term as a BarristerBooks.com Student Marketing Rep will begin as of the date you receive an acceptance email from BarristerBooks.com and end on the last day of the Semester in which you were accepted (i.e. either May 15 or December 15). At that point, renewal of your position for any subsequent semesters will be subject to agreement by both you and BarristerBooks.com. BarristerBooks.com retains the right to terminate a Student Marketing Representative position for any reason prior to or at the end of a term. Additionally, failure to complete any assigned task by a Student Marketing Rep will result in forfeiture of all benefits described below. The position, duties and benefits of a BarristerBooks.com Student Marketing Rep are not transferable or assignable without the written consent of BarristerBooks.com. Please remember that you are responsible for informing us of any address and contact information changes during your term as a Student Marketing Representative.

B. BARRISTERBOOKS.COM'S RESPONSIBILITIES

1. General Responsibilities. BarristerBooks.com will supply all promotional items. We will work closely with you to schedule promotional tasks as to not unduly interfere with your schedule.

2. Free Merchandise Benefits. As a BarristerBooks.com Student Marketing Rep, you will be entitled to BarristerBooks.com credit for each completed task per semester. The amount of credit assigned to each task will be explained to you by the Student Marketing Representative Coordinator. In addition, you will be eligible for BarristerBooks.com Student Marketing Rep program contest prizes as detailed to you by the Student Marketing Representative Coordinator.

3. Redemption. After the completion of your assignment, we will provide you with credit in the form of BarristerRewards points deposited into your BarristerBooks.com account. You may spend this credit as you wish on any purchase(s) at BarristerBooks.com.

C. MISCELLANEOUS

Governing Law. This Agreement will be governed by the laws of the State of Kansas.

Arbitration. In the event a dispute shall arise between the parties to this Agreement, it is hereby agreed that the dispute shall be referred to the American Arbitration Association for arbitration in accordance with the applicable United States Arbitration and Mediation Rules of Arbitration. The arbitrator's decision shall be final and legally binding and judgment may be entered thereon.

Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award.

Severability. If any portion of this Agreement is held to be unenforceable, that portion shall be severed from this Agreement, the remainder of which shall continue in effect.
